Illuminare House™ Terms & Conditions

These Terms & Conditions ("Terms") govern your use of IlluminareHouse.com, related webpages, forms, communications, products, services, publishing inquiries, author opportunities, and other offerings operated by GMC Capital Enterprises, LLC under the Illuminare House™ brand. By accessing the website or purchasing or using an offering, you agree to these Terms and any additional terms presented for the applicable product, service, or program.
1. Eligibility and Acceptance
You must be legally capable of entering into a binding agreement to purchase services or participate in a publishing program. If you act on behalf of an organization or another person, you represent that you are authorized to do so.
2. Website and General Information
Website content is provided for general informational and commercial purposes. We may update, correct, suspend, remove, or change website content, offerings, pricing, availability, deadlines, or features at any time, subject to any binding written agreement already in effect.
3. Publishing Inquiries, Applications, and Submissions
A submission, inquiry, application, interview, payment inquiry, or discussion with Illuminare House does not guarantee acceptance, publication, participation, distribution, or any particular publishing outcome. We may decline a project or opportunity in our discretion, subject to applicable law and any signed agreement.
Submitting material does not by itself transfer copyright or other ownership rights. If Illuminare House accepts a project or contributor, the parties may enter into a separate publishing, contributor, co-author, licensing, services, release, or other written agreement. That agreement controls if it conflicts with these general Terms.
4. Author and Contributor Responsibilities
If you submit content for consideration or publication, you are responsible for ensuring that you have the right to submit and authorize use of the material. Unless a separate agreement states otherwise, you represent that your submission will not knowingly infringe copyright, trademark, privacy, publicity, contractual, or other rights of a third party and will not contain unlawful material.
You are responsible for fact-checking factual statements, quotations, citations, permissions, names, dates, credentials, and other information you provide. Illuminare House may request documentation of permissions or sources where appropriate.
5. Intellectual Property
The Illuminare House name, branding, website design, original website copy, graphics, processes, templates, resources, and other content created or owned by Illuminare House or its licensors are protected by applicable intellectual-property laws. Except as expressly permitted, you may not copy, reproduce, republish, distribute, sell, create derivative works from, or commercially exploit such content without written permission.
Authors and contributors retain the rights they hold in their original works unless and until rights are licensed, assigned, or otherwise addressed in a separate written agreement. Publication, editing, marketing, distribution, ISBN, cover, title, sales, royalty, author-copy, and related rights are governed by the applicable project agreement.
6. Orders, Fees, and Payments
Prices, payment schedules, deposits, installment terms, taxes, shipping charges, and included deliverables are stated at checkout, in an order form, or in the applicable written agreement. You authorize us and our payment processors to charge the payment method you provide for amounts you approve.
You are responsible for providing accurate billing and contact information and for promptly updating payment information when necessary. Failed or declined payments may delay fulfillment, access, editing, production, publication, or other services.
7. Cancellation, Refunds, and Billing
Our Cancellation & Billing Policy is incorporated into these Terms. Offer-specific checkout terms or a signed publishing, author, contributor, or services agreement may contain different or additional payment and cancellation terms. If there is a conflict, the more specific written agreement or offer terms control to the extent permitted by law.
8. Books, Physical Products, and Fulfillment
Estimated printing, shipping, production, distribution, or delivery times are estimates unless expressly guaranteed in writing. Delays may occur due to printers, distributors, carriers, retailer systems, supply constraints, author approvals, production changes, or events outside our reasonable control. Risk of loss and replacement rights for physical products are subject to applicable law and the policies stated at purchase.
9. Editorial and Production Changes
Where a publishing agreement authorizes editing, design, formatting, production, or marketing activity, Illuminare House may make changes consistent with that agreement. Authors and contributors are responsible for meeting review and approval deadlines. Missed deadlines may affect production schedules, launch timing, participation, or inclusion as provided in the applicable agreement.
10. Testimonials, Reviews, and Publicity
We welcome truthful feedback. We do not require you to provide a positive review as a condition of receiving a product or service. If you voluntarily provide a testimonial, review, photograph, video, story, or endorsement, we will use it in marketing only to the extent authorized by you and applicable law. Any material connection that should be disclosed in connection with an endorsement must be disclosed clearly and conspicuously.
11. Email and SMS Communications
By providing contact information, you may receive transactional or service communications related to inquiries, applications, orders, deadlines, author programs, events, or purchases. Promotional email or SMS communications will be sent in accordance with applicable law and the consent you provide. Marketing SMS consent is not a condition of purchase. Message frequency may vary; message and data rates may apply. Reply STOP to opt out of SMS and HELP for assistance.
12. Prohibited Conduct
You may not use our website, forms, programs, communities, or materials to:
Violate law or the rights of another person.
Upload malicious code, attempt unauthorized access, interfere with website security, or misuse accounts or credentials.
Copy, scrape, reproduce, resell, teach, distribute, or exploit proprietary materials without permission.
Impersonate another person or misrepresent your identity, credentials, authorship, affiliation, or authority.
Harass, threaten, defame, or unlawfully disclose private or confidential information.
Use another author or participant’s unpublished material, story, image, or personal information without authorization.
13. Third-Party Services
We may use or link to third-party platforms for payments, book retail, printing, distribution, shipping, communications, events, analytics, or other functions. We are not responsible for independently operated third-party websites or services, and their terms may also apply to your use of those services.
14. No Guaranteed Results
Publication, participation, marketing support, distribution, or author services do not guarantee sales, rankings, bestseller status, media coverage, speaking engagements, reviews, royalties, income, audience growth, business opportunities, or any other particular result. 15. Disclaimer of Warranties
To the fullest extent permitted by law, the website and general informational materials are provided on an "as is" and "as available" basis without warranties of any kind except warranties that cannot legally be excluded. Specific contractual warranties, if any, are governed by the applicable written agreement.
16. Limitation of Liability
To the fullest extent permitted by law, Illuminare House and GMC Capital Enterprises, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or general informational materials. Nothing in these Terms limits liability that cannot legally be limited. Liability relating to a specific paid publishing or services engagement is also subject to the applicable written agreement.
17. Indemnity
To the extent permitted by law and subject to any more specific written agreement, you agree to be responsible for claims, losses, or expenses arising from material you submit, your violation of these Terms, or your infringement of another person’s rights. Any project-specific indemnification obligations are governed by the applicable publishing or contributor agreement.
18. Governing Terms and Disputes
These Terms are intended to be interpreted under applicable United States law. Any project-specific governing-law, venue, arbitration, mediation, or dispute-resolution provision in a signed agreement will control for that project. Nothing in these Terms waives consumer rights that cannot lawfully be waived.
19. Changes to These Terms
We may update these Terms from time to time. Updated Terms apply prospectively from the date posted unless applicable law requires otherwise. Changes do not retroactively alter a signed agreement unless the parties agree in writing.
